Terms of Service

ClaySquad Terms of Service

ClaySquad is a website owned and operated by un9 ltd., a Colorado limited liability company. These Terms govern your use of ClaySquad (the "Service"). They are between you and un9 ltd., not any individual person.

1. Acceptance of Terms & Eligibility

By registering an account or using ClaySquad ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, our Community Code of Conduct, and our Release and Waiver of Liability Agreement. You must be at least 18 years of age to use this Service. By registering, you confirm and warrant that you meet this requirement. If you do not agree to these terms, do not use the Service.

2. Account Registration & Gender

  • Passwordless Authentication: We use passwordless multi-method authentication (including Social OAuth, Magic Links, and Magic Codes). You are entirely responsible for maintaining the confidentiality and security of your linked email address and social media login credentials.
  • Gender: You must select your gender marker during registration (Male, Female, or Prefer not to say) for matching other users squad preferences.

3. Public-Only Communication & Privacy Standards

  • No Private Contact Harvesting: To protect user anonymity and safety, all squad coordination and communication must occur within the provided Squad Requests and Replies. You are strictly prohibited from publishing, soliciting, or demanding private contact information—including phone numbers, personal email addresses, physical addresses, or social media handles—within those messages or as a condition for joining a squad. An approved instructor listing may publish the instructor's chosen website and public business/contact phone.
  • Closed-Loop Clubhouse Identification: Accepted squad participants are provided anonymous visual badges and squad keywords generated by ClaySquad on its own servers. You may use these on-screen tools to identify your squad-mates at physical venues. Optional display name sharing is voluntary and controlled by each member in Profile settings; badge and keyword identification remains available to members who keep their display name hidden.
  • Optional Display Name Sharing: If you choose to share a display name, you are solely responsible for the name you enter and for understanding the selected visibility level. By saving a display name with consent, you instruct ClaySquad to show that name, together with your username, to the permitted audience inside the signed-in Service. ClaySquad does not show display names in email or in-app notifications.

4. User-Coordinated Affinity Squads & Warning Engagements

  • Affinity Group Settings: The Service allows users to post "Squad Requests" and designate attendance preferences, such as gender-specific affinity groupings (e.g., "Females Only" or "Males Only") to foster comfort and camaraderie. These are user-driven preferences.
  • Warning System Engagement (Replying): The Service does not block users based on sex. However, if your profile identity does not match the creator's squad preference (or if you select "Prefer not to say"), the system will display a prominent warning before allowing a reply submission. Entering or disrupting a squad where you do not meet the requested criteria is a direct violation of our Code of Conduct.
  • Warning System Engagement (Creating): Users registered under the "Prefer not to say" gender setting retain the right to create gender-specific affinity requests.
  • No Pay-to-Play on Squads: You may not use Squad Requests or replies to advertise, sell, or solicit goods, commercial services, tips, or entry fees. You may not charge or demand money to allow a user to join a squad. Commercial instruction may be promoted only through an approved instructor listing.

5. Public Instructor Listings

  • Opt-In Public Data: By submitting an instructor listing, you authorize ClaySquad to publish its approved name, person photo, professional details, contact details, self-reported NSCA details, and teaching clubs on searchable pages. Search engines and other third parties may retain copies after you change or remove the listing.
  • Truthful Claims: You must keep every identity, credential, price, safety, and club-affiliation claim accurate. Appearing on ClaySquad does not mean a listed club or ClaySquad endorses you or verifies those claims.
  • Review and Moderation: ClaySquad reviews listing completeness and appropriate content only. A report remains pending without hiding the listing. ClaySquad may reject changes, unpublish a listing, restore it, apply write restrictions, or remove listing access under its moderation rules.
  • Lessons and Payments: ClaySquad provides discovery and contact information only. It is not a party to instruction, scheduling, prices, contracts, lessons, payments, refunds, safety decisions, or disputes between an instructor and another person.

6. Private Squad Arrival Check-Ins

  • Self-Reported Arrival: On the club-local shoot date, organisers and accepted squad members may privately report that they have arrived and may add an optional location note for the roster. The Service does not verify attendance or collect browser location for a check-in.
  • Reversible During the Shoot Date: You may change your location note or undo a check-in until 11:59:59pm on the shoot date in the club timezone. If you check in again, the Service records a fresh check-in time.
  • Private History and Notifications: Check-in activity is visible only to the organiser and accepted members of that squad. Meaningful changes are kept as private squad history and notify the other current roster members by email and in-app notification.

7. Automated Moderation & Content Reporting System

  • Immediate Suspension Triaging: You acknowledge and agree that a single report from an authenticated user against a Squad Request or Reply may result in the immediate, automated public suspension and hiding of that content pending human moderator review. Instructor listing reports do not hide the listing before a decision.
  • Discretionary Review: Automated triaging does not constitute a final determination of wrongdoing. ClaySquad retains absolute, unreviewable discretion to uphold, dismiss, or revise any moderation decision.

8. Third-Party Services Disclaimer

The Service uses third-party tools and services, including Google Maps Embed, MaxMind GeoIP, Matomo analytics, and Cloudflare Turnstile. Details of the geographic data sources used for location features are described on the Data sources page. We do not own, control, or maintain these external services. We express no warranties or liabilities regarding the uptime, accuracy, lawfulness, or safety of any third-party data, maps, or images rendered via these services.

9. SAFETY DISCLAIMER & ASSUMPTION OF RISK

CRITICAL NOTICE: REAL-WORLD MEETUPS & FIREARMS SAFETY ClaySquad facilitates introductions between shooters but takes no responsibility for real-world meetings, transportation, or interactions that arise from the use of the Service. Always exercise extreme caution when meeting strangers.

Firearms handling, safety rules, instruction, and venue regulations are solely governed by the independent physical shooting clubs and ranges visited by users. ClaySquad does not mandate, monitor, or enforce specific firearm safety rules on-site.

You acknowledge that shooting sports and instruction involve inherent risks. You assume all risk associated with meeting individuals encountered through the Service, taking lessons, and attending physical shooting facilities. We strongly recommend that you arrange to meet new people for the first time in a public area of the club, such as the clubhouse or pro shop, before proceeding to the course.

10. Limitation of Liability & Indemnification

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, un9 ltd., its officers, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the platform, user interactions, or real-world meetups arranged through it. In no event shall the total aggregate liability of un9 ltd. for all claims, damages, losses, or causes of action arising out of or relating to the Service exceed one hundred U.S. dollars ($100.00 USD) or the total amount you paid to un9 ltd., if any, in the twelve (12) months prior to the claim. You agree to indemnify and hold harmless un9 ltd. from any claims or damages resulting from your breach of these Terms or your actions during physical meetups.

11. Governing Law, Mandatory Binding Arbitration & Class Action Waiver

A. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. B. Binding Arbitration: You and un9 ltd. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or user interactions shall be settled exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Any arbitration hearing shall take place in Colorado or virtually. C. Class Action Waiver: YOU AND UN9 LTD. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of a class proceeding.
